There's even some gray area regarding kernel modules. In fact,
you can even produce a non-GPL patch to the kernel code without
violating the GPL, as long as you don't distrubute your modified
kernel. (Distributing your patch and letting others apply it
to their own kernels is OK, as far as I can tell.) The same
applies to modules: you can create a non-GPL kernel module, but
you can't distribute the kernel and the non-GPL module together.
